Please read these Terms and Conditions (“Terms”) carefully before purchasing a course, booking an examination or using the Functionalskills.co.uk website and associated services operated by Oakwood Home Learning Limited, a company registered in England and Wales under company number 09955855 (“we”, “us”, “our” or the “Company”).

These Terms set out the conditions that apply when you use Functionalskills.co.uk, purchase a course or examination, access course materials or use any associated service.

If you do not agree to these Terms, you must not use our website, purchase a course or examination, or access our training materials.

We may review and update these Terms from time to time. Any updated Terms will be published on the website. You should check this page periodically for changes. Your continued use of the website or our services after revised Terms take effect will constitute acceptance of those changes.

Nothing in these Terms affects your statutory rights.

Purchases

When purchasing a product or service through our website, you may be asked to provide information relevant to your purchase, including your name, contact details, billing address and payment information.

Your personal information will be handled in accordance with our Privacy Policy.

You confirm that:

  • You have the legal right to use the payment method provided.
  • The information you provide is true, accurate, current and complete.
  • You are authorised to make the purchase.

We will not be responsible for any loss or delay caused by false, inaccurate or incomplete information supplied by you.

We reserve the right to refuse or cancel an order where:

  • A product or service is unavailable.
  • There is an error in the description or price.
  • There is an error in your order.
  • Fraud or an unauthorised or illegal transaction is suspected.
  • We are unable to process or verify payment.
  • We have another legitimate reason for refusing the order.

Where we cancel an order after payment has been taken and no product or service has been supplied, we will provide an appropriate refund.

Nothing in this section limits any rights or remedies available to you under applicable consumer law, including the Consumer Rights Act 2015 and the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.

Course Purchases and Access

Courses are purchased through a single, one-off payment. We do not operate a monthly subscription service, and course purchases do not renew automatically.

Unless otherwise stated on the relevant course page, purchasing a course provides the named learner with access to the course materials and associated online services for 12 months from the date of purchase.

Course access will expire automatically at the end of the 12-month access period, regardless of whether the learner has completed the course.

It is the learner’s responsibility to complete all required course activities and assessments before access expires.

Course access is personal to the learner named during registration. Access must not be transferred, shared, resold or used by another person.

Any examination, assessment, resit, certification or additional service that is not expressly stated as being included in the course description may require a separate payment.

Purchasing a course does not guarantee that the learner will:

  • Pass an assessment or examination.
  • Obtain a qualification or certificate.
  • Secure employment.
  • Gain admission to another course or university.
  • Satisfy the entry requirements of an employer, university, apprenticeship provider or other organisation.

Learners are responsible for checking that a course is suitable for their requirements and that it will be accepted for their intended purpose before purchasing.

Course Extensions

We may, at our discretion, allow a learner to extend their course access beyond the original 12-month period.

Extensions are not guaranteed and may be subject to an additional fee and any conditions in place at the time of the request.

Learners who require additional time should contact us before their original course access expires.

Any extension granted will apply only for the period confirmed by us in writing.

Course Delivery and Access

Following successful payment, learners will normally receive access to their online course immediately.

Login details and purchase confirmation will be sent to the email address supplied during registration.

Learners should contact us if they do not receive access within a reasonable period after completing their purchase.

Course access lasts for 12 months from the purchase date unless:

  • A different access period is clearly stated on the relevant course page.
  • An extension has been purchased or granted.
  • A different period has been agreed by us in writing.

We may update, replace or improve course content during the access period. Any replacement content will cover substantially the same subject matter and will be provided to an appropriate standard.

We do not guarantee that the website or course platform will always be available without interruption. We may temporarily restrict access where reasonably necessary for maintenance, security, updates or circumstances outside our reasonable control.

Where a significant interruption is caused by us, we will take reasonable steps to restore access and, where appropriate, may extend the affected learner’s access period.

Learners should report technical problems or suspected inaccuracies in the course materials as soon as reasonably possible.

If we are unable to provide a purchased course or a suitable equivalent, the learner may be entitled to an appropriate remedy, which may include a refund.

Tutor Support

Where tutor support is included, it will be available during the learner’s course access period, subject to any limitations explained on the relevant course page.

Tutor support does not guarantee that a learner will pass a course, assessment or examination.

Learners must communicate respectfully with tutors, assessors, staff and other learners.

We reserve the right to restrict communication or suspend access where a learner behaves in an abusive, threatening, discriminatory or otherwise inappropriate manner.

Cancellation Rights for Course Purchases

Our courses contain digital content that is normally made available immediately after purchase.

During checkout, you may be asked to:

  • Expressly request that access to the digital content begins during the statutory cancellation period.
  • Acknowledge that you will lose your right to cancel once the supply of the digital content begins.

Where you give this express consent and acknowledgement, your right to cancel the digital-content element of the purchase will end when access to that digital content is provided.

Where you have not expressly requested immediate access, any applicable cancellation rights will be handled in accordance with the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.

Where a course includes services that begin during the cancellation period at your express request, you may be required to pay for any services supplied before cancellation.

Nothing in these Terms affects your statutory rights where digital content or services are faulty, not as described or not provided with reasonable care and skill.

To request a cancellation where a cancellation right still applies, you must contact us and provide sufficient information to identify your purchase.

Refunds for Course Purchases

Course fees are paid as a one-off payment and do not renew automatically.

Refund requests will be considered in accordance with these Terms and your statutory rights.

A refund will not normally be provided merely because:

  • The learner has changed their mind after immediate digital access has begun with the required consent and acknowledgement.
  • The learner has not used the course.
  • The learner has failed to complete the course within the access period.
  • The learner no longer requires the course.
  • The course is not accepted by a particular employer, university or organisation where the learner did not check its requirements before purchasing.
  • The learner does not pass an assessment or examination.
  • The learner is removed from a course because of plagiarism, misconduct or a serious breach of these Terms.

This does not affect any statutory right to a refund, repair, replacement, repeat performance or price reduction where applicable.

Approved refunds will normally be returned using the original payment method.

Examination Purchases

Examinations may be sold separately from courses unless the relevant course description expressly states that an examination is included.

Learners are responsible for checking the examination level, subject, awarding organisation, entry requirements and any technical or identification requirements before booking.

When an examination is purchased, we may reserve a date or time and make arrangements with the relevant awarding organisation, examination centre or examination provider.

Examination fees are non-refundable once the booking has been confirmed and the relevant arrangements have been made, except where a refund is required by law or where we or the examination provider are unable to provide the booked examination.

Requests to cancel, transfer or reschedule an examination are subject to:

  • The rules of the relevant awarding organisation or examination provider.
  • Availability.
  • Applicable deadlines.
  • Any administration or rescheduling charges.
  • Any additional examination fees.

A learner who fails to attend an examination, does not provide acceptable identification, does not meet the technical requirements or breaches examination rules may lose the examination fee and may need to pay for another booking.

Where an examination is cancelled by us or the relevant examination provider, we will offer an appropriate remedy, which may include rescheduling the examination or providing a refund.

Nothing in this section affects your statutory rights.

Examination Results and Certificates

Examination results and certificates are issued subject to the processes and timescales of the relevant awarding organisation or examination provider.

Any estimated result or certificate timescale is provided as guidance and is not guaranteed where the process is controlled by a third party.

We are not responsible for delays caused by an awarding organisation or examination provider, but we will provide reasonable assistance where a learner reports an issue.

Certificates will normally be issued using the learner information provided during registration or examination booking. Learners are responsible for ensuring that their personal details are accurate.

Charges may apply where a replacement certificate or correction is required because the learner provided incorrect information.

Accounts

When creating an account, you must provide information that is accurate, complete and current.

Failure to provide accurate information may result in delays, incorrect learner records or suspension of your account.

You are responsible for safeguarding the password used to access your account and for activity carried out through that account.

You must not:

  • Disclose your password to another person.
  • Allow another person to access your course or account.
  • Use another learner’s account.
  • Attempt to gain unauthorised access to the website, course platform or another account.
  • Use an offensive, unlawful or misleading username.

You must notify us promptly if you become aware of any unauthorised use of your account or other security breach.

We will not be responsible for loss caused by your failure to keep your login details secure, except where that loss results from our failure to exercise reasonable care and skill or another matter for which liability cannot legally be excluded.

Learner Responsibilities

Learners must:

  • Use the website and course platform lawfully.
  • Complete their own work.
  • Follow all assessment and examination rules.
  • Treat staff, tutors, assessors and other learners respectfully.
  • Keep their contact information up to date.
  • Check relevant course and examination requirements.
  • Use suitable equipment and a reliable internet connection where required.
  • Report technical or access issues within a reasonable period.
  • Complete all required work before course access expires.

Learners must not:

  • Copy, distribute, resell or publish course materials.
  • Share course access with another person.
  • Submit work completed by another person.
  • Use artificial intelligence or other tools contrary to the assessment rules.
  • Upload viruses, malicious code or harmful material.
  • Interfere with the operation or security of the website.
  • Use the Service for unlawful, fraudulent or abusive purposes.

Plagiarism and Academic Misconduct

Plagiarism and academic misconduct are treated as serious matters.

All submitted work must be the learner’s own unless collaboration or the use of external sources has been expressly permitted.

Academic misconduct may include:

  • Copying another person’s work.
  • Allowing another person to complete an assessment.
  • Submitting purchased or commissioned work.
  • Failing to acknowledge sources.
  • Using artificial intelligence contrary to the relevant assessment rules.
  • Falsifying evidence or learner information.
  • Sharing assessment answers with another learner.

Where we reasonably believe that plagiarism or academic misconduct has occurred, we may investigate the matter and take appropriate action.

Action may include:

  • Requiring the learner to resubmit work.
  • Applying an assessment penalty where permitted.
  • Refusing to issue a certificate.
  • Suspending or terminating course access.
  • Reporting the matter to an awarding organisation or relevant authority.

A learner removed from a course because of proven plagiarism or serious academic misconduct will not normally be entitled to a refund. This does not affect any statutory rights that cannot legally be excluded.

Intellectual Property

The website, course materials, assessments, graphics, videos, documents, branding, features and functionality are owned by or licensed to the Company and are protected by applicable intellectual property laws.

Purchasing a course gives the named learner a limited, personal, non-exclusive and non-transferable right to access and use the relevant materials for private study during the course access period.

Learners must not, without our prior written permission:

  • Copy or reproduce course materials except for reasonable personal study.
  • Distribute, publish or upload course materials.
  • Sell, sublicense or commercially exploit course materials.
  • Share assessments or answers.
  • Modify or adapt course content for redistribution.
  • Remove copyright, trade mark or ownership notices.
  • Record or redistribute live or recorded teaching content.

Any unauthorised use of our intellectual property may result in suspension or termination of access and may lead to legal action.

Third-Party Websites and Services

Awarding Organisations and Course Changes

We may change an awarding organisation where reasonably necessary, including where:

  • An awarding organisation withdraws a qualification.
  • Approval or availability changes.
  • Regulatory requirements change.
  • Continuing with the original awarding organisation is no longer reasonably practicable.

Where a change is necessary, we will take reasonable steps to provide a suitable alternative at the same or a comparable level.

We will inform affected learners of any material change and explain the available options.

A change will not reduce any statutory rights available to the learner.

Suspension and Termination

We may suspend or terminate an account or course access where the learner:

  • Materially breaches these Terms.
  • Shares account or course access.
  • Uses the Service unlawfully or fraudulently.
  • Engages in plagiarism or serious academic misconduct.
  • Abuses or threatens staff, tutors, assessors or other learners.
  • Attempts to interfere with the website or course platform.
  • Fails to make a payment that is properly due.
  • Breaches examination or awarding-organisation rules.

Where appropriate, we will give the learner notice of the breach and a reasonable opportunity to resolve it before suspending or terminating access.

We may suspend access immediately where reasonably necessary to protect learners, staff, systems, confidential information, intellectual property or the integrity of an assessment or examination.

If we materially breach these Terms and do not remedy the breach within a reasonable period after being notified, the learner may be entitled to terminate the agreement and seek an appropriate remedy.

Termination does not affect any rights or obligations that arose before termination.

Sections that are intended to continue after termination, including intellectual-property, liability and governing-law provisions, will remain in effect.

Availability of the Service

We aim to keep the website and course platform available, but we do not guarantee uninterrupted or error-free access.

Access may be temporarily unavailable due to:

  • Maintenance or system updates.
  • Technical faults.
  • Security incidents.
  • Internet or hosting failures.
  • Third-party service interruptions.
  • Events outside our reasonable control.

We will take reasonable steps to resolve issues within our control.

We do not exclude liability for failing to provide digital content or services in accordance with your statutory rights.

Limitation of Liability

Nothing in these Terms excludes or limits liability for:

We will not be responsible for loss caused by:

  • False or inaccurate information supplied by the learner.
  • The learner failing to check entry or acceptance requirements.
  • The learner failing to complete the course during the access period.
  • The learner failing to meet examination requirements.
  • Circumstances outside our reasonable control.
  • Unauthorised access resulting from the learner failing to safeguard their login details.

This section does not affect your statutory rights or limit our responsibility to provide digital content and services with reasonable care and skill.

Indemnity

Where you use the Service for business purposes, you agree to compensate us for reasonable losses, costs or claims resulting directly from your unlawful use of the Service, infringement of intellectual property rights or deliberate breach of these Terms.

This clause does not apply to ordinary consumers using the Service wholly or mainly for purposes outside their trade, business, craft or profession.

Disclaimer

The information and training materials supplied through the Service are provided for educational purposes.

Unless expressly stated otherwise, course materials do not constitute professional, legal, medical, financial or regulatory advice.

You are responsible for obtaining appropriate professional advice where required.

We do not guarantee that completing a course will result in employment, progression, admission to another institution or any particular outcome.

Nothing in this section excludes our obligation to provide digital content and services in accordance with applicable consumer law.

Severance

If any provision of these Terms is found by a court or other competent authority to be invalid, unlawful or unenforceable, that provision will be treated as removed or modified only to the minimum extent necessary.

The remaining provisions will continue in full force and effect.

No Waiver

If we do not immediately enforce a right or remedy under these Terms, this does not mean that we have waived that right or remedy.

A waiver will only be effective where it is confirmed in writing.

Entire Agreement

These Terms, together with any applicable course description, examination information, Privacy Policy and Cookie Policy, constitute the agreement between you and us concerning the relevant purchase and use of the Service.

Nothing in this section excludes liability for fraud or fraudulent misrepresentation.

Governing Law and Jurisdiction

These Terms are governed by the laws of England and Wales.

If you are a consumer resident in another part of the United Kingdom, you may also be entitled to bring proceedings in the courts of the jurisdiction in which you live.

By continuing to use the Service after updated Terms take effect, you agree to be bound by the revised Terms.

If you do not agree to revised Terms, you should stop using the Service and contact us to discuss any existing purchase.
